1. Platform Status, Regulatory Scope & Professional Independence
- Technology Infrastructure Provider: BookmyCA provides software, digital workflows, document management, communication channels, administrative tools, and related technology infrastructure. BookmyCA is not a Chartered Accountancy firm, Company Secretarial firm, Cost Accountancy practice, law firm, or registered tax advisory firm, and does not hold itself out as practising any regulated profession under applicable professional laws.
- No Fiduciary or Professional Relationship: Mere access to, browsing of, account creation on, or transmission of information through BookmyCA does not, by itself, create a Chartered Accountant–client, auditor–client, advocate–client, tax advisor–client, or other fiduciary or professional relationship between BookmyCA and the user.
- Independent Professional Engagements: Regulated or specialised professional services, including audits, certifications, attestations, legal opinions, tax representations, appearances before judicial or quasi-judicial bodies, and formal regulatory filings, may be provided by independent appropriately qualified professionals. Any professional engagement, mandate, retainer, or advisory relationship is between the user and the engaged professional. The engaged professional retains professional independence and responsibility for the professional advice, filings, representations, attestations, and other professional work they provide.
- Platform Charges & Professional Fees: Fees or subscription charges paid to BookmyCA relate to its software, technology infrastructure, workflow tools, document-management capabilities, administrative interfaces, and communication facilities, as applicable. BookmyCA structures its platform charges and professional engagements separately from professional fees and in accordance with applicable laws and professional regulations.
2. AI, Automated Processing & Regulatory Content
- Workflow Assistance: BookmyCA may use artificial intelligence, machine-learning models, optical character recognition (OCR), automated data extraction, rule-based processing, and other technologies to read and classify documents, identify potential data inconsistencies, organise compliance checklists, support workflows, and assist with administrative drafting.
- Automated Output Limitations: Automated outputs are assistive and may contain factual inaccuracies, omissions, processing errors, incomplete logic, or outdated interpretations. Automated outputs do not constitute audited data, certified accounts, formal tax computations, legal opinions, or professional certifications. Where professional judgement is required, such outputs are intended to support and not replace independent evaluation and review by an appropriately qualified professional.
- Informational & Non-Advisory Content: Compliance calendars, due-date alerts, tax calculators, statutory summaries, regulatory updates, procedural roadmaps, checklists, and similar information published through BookmyCA are provided for general informational and educational purposes. Requirements may vary depending on the user's facts, applicable law, jurisdiction, regulatory guidance, and administrative interpretation. Information provided through the platform does not, by itself, constitute legal, accounting, tax, financial, or other professional advice.
3. Digital Signatures, Credentials & Data Authorisation
- Digital Signatures & Token Security: BookmyCA does not request or take custody of a user's physical Digital Signature Certificate (DSC) hardware token or private signing keys as part of its platform operations. The custody and use of digital signatures remain subject to the applicable legal and security requirements governing the relevant signatory and credential. Any affixing of a DSC to statutory forms should be carried out by the authorised signatory or in accordance with applicable authorisation procedures.
- Statutory Credentials & OTPs: BookmyCA advises users against sharing master login credentials, portal passwords, DSC PINs, or one-time passwords (OTPs) for government or statutory portals, including the Income Tax Portal, MCA, GSTN, TRACES, EPFO, and ESIC. Where users choose to provide access credentials, access roles, or filing authorisations to an independent professional, such access should be provided only through appropriate authorised mechanisms and remains subject to the user's applicable rights and responsibilities.
- User Authorisation & Data Responsibility: Users are responsible for ensuring that they have the requisite legal authority, consent, authorisation, board approval, power of attorney, or other applicable permission to disclose, upload, and process personal identifiers, PAN, Aadhaar information, financial records, banking statements, corporate documents, and other information submitted through the platform.
4. Government Portals, Statutory Decisions & Third-Party Services
- Government & Statutory Systems: Compliance processes may depend on external statutory and government systems, including MCA21, GSTN, the Income Tax Portal, TRACES, DGFT, ICEGATE, and state government or revenue portals. BookmyCA does not own, operate, or control these external systems.
- Portal Availability & Government Actions: BookmyCA is not responsible for government portal downtime, gateway timeouts, technical errors, maintenance, processing queues, administrative delays, changes to procedures, revised forms, deadline changes, scrutiny selection, requests for additional information, or decisions made by statutory authorities, except to the extent otherwise required under applicable law.
- No Outcome Guarantee: BookmyCA does not represent, guarantee, or warrant the approval, clearance, issuance, refund, registration, licence, scheme approval, scrutiny outcome, assessment, or appeal result of any matter submitted to a government or statutory authority. Outcomes depend on the facts of the matter, information and documents provided, applicable requirements, professional assessment where relevant, and decisions of the competent authority.
- Third-Party Infrastructure: BookmyCA may rely on external telecommunications providers, messaging platforms, cloud infrastructure providers, payment aggregators, banking services, identity-verification services, and other third-party technology providers. BookmyCA is not responsible for interruptions or failures attributable to such third-party services, except to the extent liability cannot lawfully be excluded or limited.
5. Service Timelines, User Cooperation & Outcomes
- Commercial Estimates: Any turnaround time, delivery date, processing estimate, or completion milestone displayed on dashboards, marketing materials, or platform interfaces is an operational estimate based on expected conditions. It does not constitute a statutory deadline, service-level commitment, or binding guarantee unless expressly agreed in a separate written agreement.
- User Cooperation: Service timelines may depend on the timely provision of information, documents, approvals, signatures, authorisations, and other inputs required from the user. Delays attributable to incomplete, inaccurate, or late user submissions may affect the applicable service timeline and may result in additional statutory consequences imposed by the relevant authority or professional.
- No Particular Outcome: BookmyCA does not guarantee a particular commercial, tax, regulatory, registration, licensing, filing, refund, audit, assessment, or other statutory outcome. Outcomes may depend on circumstances and decisions outside BookmyCA's control.
6. Scope, Professional Engagements & Non-Excludable Rights
- Primacy of Professional Engagement: Where a user has separately entered into a written engagement letter, mandate, retainer, or other professional agreement with an independent professional, that professional engagement governs the professional services provided by that professional. Platform information or administrative workflow outputs do not replace the terms of that professional engagement.
- Severability: If any provision of this Disclaimer is found to be invalid, unlawful, or unenforceable under applicable Indian law, that provision shall be interpreted or severed to the extent necessary without affecting the validity and enforceability of the remaining provisions.
- Preservation of Statutory Rights: Nothing in this Disclaimer is intended to exclude, restrict, or limit any consumer right, legal remedy, statutory protection, or liability that cannot lawfully be excluded, restricted, or limited under applicable law.
- Professional Advice: Where a matter requires tailored legal interpretation, complex tax analysis, statutory certification, audit, representation, or other regulated professional judgement, users should obtain advice from an appropriately qualified professional.
