Unless explicitly stated otherwise, these professionals are responsible for the professional advice, filings, documentation, and services they provide.

BookmyCA does not guarantee a particular legal, tax, regulatory, financial, or business outcome.

Technology Platform & Professional Independence

BookmyCA operates strictly as an intermediary technology and workflow software provider under Section 79 of the Information Technology Act, 2000. It is not a CA, CS, legal, or accounting firm. All regulated statutory deliverables (audits, certifications, tax representations) are performed solely by independent, licensed professionals under separate bilateral contracts. Platform charges cover software access and administrative infrastructure only, never prohibited professional fee-splitting.

User Data Governance & Privacy Roles

Under the Digital Personal Data Protection (DPDP) Act, 2023, you act as the Data Fiduciary responsible for securing all legal consents and board authorizations before uploading business, employee, or personal data. BookmyCA operates strictly as a Data Processor, handling your uploaded records and credentials solely to deliver requested software workflows.

Digital Signatures (DSC) & Credential Custody

BookmyCA never takes custody of physical DSC hardware tokens, USB cryptotokens, or private signing keys. Affixing digital signatures remains the exclusive physical and statutory responsibility of the authorized signatory under the IT Act, 2000. Users are advised not to share master statutory portal passwords or OTPs and remain fully liable for the authenticity of all submitted documents.

AI & Automated Processing Limitations

All artificial intelligence, OCR, and automated reconciliation tools provided across the platform are strictly assistive and probabilistic. Automated outputs do not constitute audited financial statements, tax computations, or formal legal advice and must always be reviewed and validated by an appropriately qualified professional prior to reliance or filing.

Payment Terms & Strict Non-Refundable Policy

All platform subscription fees, software license charges, statutory portal fees, and professional retainers are payable in advance and are strictly final and 100% non-refundable under all circumstances. Fees are deemed fully earned upon account provisioning or workflow initialization. Non-refundability applies universally, including in instances of statutory rejections, administrative delays, or third-party portal downtime. Unilateral chargebacks are prohibited.

Liability Limits, Compliance Rules & Dispute Resolution

Users must comply with Rule 3(1) of the IT Rules, 2021 and refrain from uploading fraudulent, infringing, or unlawful records. BookmyCA's aggregate financial liability is capped at the platform technology fees paid by you in the preceding three (3) months. Disputes are subject to binding arbitration and the exclusive jurisdiction of the competent courts in India, supported by a formal Grievance Redressal Officer mechanism.
